Terms of Use for LUUMI

By downloading, installing, or using the LUUMI mobile application (“the App”), you agree to these Terms of Use. If you do not agree to these Terms, please do not use the App.
1. Use of the Ap
LUUMI is provided solely for entertainment purposes.
The App includes augmented reality (AR) features that overlay digital content onto the real world. LUUMI may be used in any environment, including but not limited to indoor, outdoor, public, or private spaces.
You agree to use the App responsibly and in compliance with all applicable laws and regulations.
2. Augmented Reality Safety Notice
LUUMI uses augmented reality technology that may affect your perception of your surroundings. When using AR features, you acknowledge and agree that:

AR content may distract you from real-world hazards

You must remain aware of your physical surroundings at all times

You should only use the App when it is safe to do so

You should stop using the App immediately if you feel unsafe, disoriented, or distracted
You must not use the App while:

Driving
-
Cycling
-
Operating machinery
-
Crossing streets
-
Performing any activity that requires full attention
LUUMI does not replace common sense, situational awareness, or personal judgment.
3. User Responsibility & Environmental Awareness
LUUMI may be used in any environment. Regardless of location, you are solely responsible for your own safety while using the App.
You agree to remain alert to, and take appropriate precautions against:

Traffic and vehicles
-
Uneven, slippery, or unstable surfaces
-
Physical obstacles and structures
-
Environmental conditions (including weather and lighting)
-
Other people, animals, or potential hazards
LUUMI is not a navigation, fitness, medical, or safety application and does not provide real-world hazard detection, warnings, or guidance.
4. Assumption of Risk
You understand and acknowledge that using an augmented reality application involves inherent risks, including but not limited to:

Trips, slips, or falls

Collisions with objects, vehicles, or people

Environmental or situational hazards
By using LUUMI, you voluntarily assume all risks associated with its use, whether indoors or outdoors.
5. Limitation of Liability
To the fullest extent permitted by applicable law: LUUMI, its developer, and any affiliated parties shall not be liable for any accidents, injuries, damages, losses, or claims arising from or related to:

The use or misuse of the App

Use of AR features
-
Use of the App in any environment
This includes, without limitation, personal injury, property damage, or other losses.
6. No Warranties
LUUMI is provided “as is” and “as available”, without warranties of any kind, express or implied, except where such warranties cannot be excluded under applicable law.
We do not warrant that the App will:

Be error-free
-
Be uninterrupted
-
Meet your expectations
-
Be suitable for any specific purpose
7. Consumer Rights (The Netherlands & EU)
Nothing in these Terms of Use is intended to exclude or limit any mandatory consumer rights you may have under applicable Dutch or European Union law.
In particular:

Statutory rights relating to digital content and services remain fully applicable

Any limitation or exclusion of liability applies only to the extent permitted by law

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect
8. Changes to the App
We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice.
9. Changes to These Terms
We may update these Terms of Use from time to time. Continued use of the App after changes are made constitutes acceptance of the updated Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to conflict of law principles.
